REACH: New Web Portal for Downstream Users

If you are a downstream user (DU) you will be pleased to learn that ECHA have launched a new website section specifically for you. The site offers DU's more information such as roles and obligations, fact sheets and guidance documents.

The site will help with your obligations regarding exposure scenarios (ES). You may start to receive an ES as part of the new safety data sheet requirements, these ES derived from the Chemical Safety Report (CSR) include operational conditions, risk management measures and routes of exposure for workers, the public and the environment. Once received the ES has to be reviewed to check several key issues:

1. has your use been covered;

2. does the way the use has been described in the ES match the way you use the substance; and

3. do the Risk Management Measures (RMM) described in the ES compare to how you protect your workers, consumers and the environment.

If your use has not been covered, you as a DU have 6 months to report this to ECHA and may be obliged to create your own CSR. As a DU you have 12 months to comply with the ES once the SDS containing the registration number and ES has been received.

Get ready for the 2013 deadline

ECHA have announced that a new list of substances to be registered in 2013 will be published in 2011 on the ECHA website. ECHA urges 2013 registrants not only to check the new list, but also to inform ECHA about their intention to register by 2013. The key message is to start preparations now, it is less than 2 years away. It is expected that the 2013 deadline will be more complex than the 2010 deadline due to more SME companies and speciality chemicals with limited data sets available.

For those registered in 2010, watch for communication from the Agency in early 2012 as ECHA and the Member State Competent Authorities will be finalising the first dossier evaluations, and will be communicating the results to the registrants. This is a critical phase in REACH because some registrants might be required to update their dossiers.
